These Terms & Conditions (“Terms”) govern your access to and use of kovarow.com (the “Site”), operated by Kova Row LLC (“Kova Row,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

The Site provides information about Kova Row, a strategy-led creative studio offering strategy, partnerships, activation, and execution services to sports and wellness brands, including our work, services, and ways to contact us. The Site is informational and does not itself sell goods or process e-commerce transactions. Any actual client engagement for Kova Row's services is governed by a separate written agreement between Kova Row and the client, and these Terms do not modify the terms of any such agreement.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any way that violates applicable law; attempt to gain unauthorized access to the Site or its related systems; interfere with or disrupt the operation of the Site; or use any automated means to scrape or harvest content from the Site without our prior written consent.

All content on the Site, including text, graphics, logos, images, video, and the selection and arrangement thereof (the “Content”), is owned by Kova Row LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and download Content solely for your own personal use. You may not reproduce, distribute, modify, publicly display, or create derivative works from any Content without our prior written permission.

“Kova Row” and associated logos are trademarks of Kova Row LLC. Other trademarks appearing on the Site, including client and partner names and marks, are the property of their respective owners and are used for identification purposes only; their appearance does not imply endorsement.

If you submit information through our contact form, newsletter sign-up, or otherwise send us materials or feedback (“Submissions”), you grant Kova Row a non-exclusive, royalty-free, worldwide license to use that Submission to respond to you, operate the Site, and improve our services. Do not submit confidential or proprietary information through the Site unless we have agreed in writing to keep it confidential.

If you opt in to receive updates, insights, and news from Kova Row, we will send communications consistent with your consent. You may unsubscribe at any time using the link provided in those communications or by contacting us directly.

The Site may contain links to third-party websites or platforms (including Instagram and LinkedIn) and references to client projects and partners. We do not control and are not responsible for third-party content, websites, or practices, and inclusion of a link or reference does not imply our endorsement.

The Site and its Content are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on the Site is complete, accurate, or current.

To the fullest extent permitted by law, Kova Row LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of, or inability to use, the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site is limited to one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless Kova Row LLC and its members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties, or for any other reason in our discretion.

We may revise these Terms from time to time. Changes are effective when posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kova Row regarding use of the Site.
